Terms and Conditions of the Online Store – Studioexpress Patrycja Witoń

§ 1 Preliminary Provisions

1. The online store at www.studioexpress.pl is operated by Studioexpress Patrycja Witoń, headquartered at Strzeszyńska 33, 60-479 Poznań, and registered in the Central Registration and Information on Business (CEIDG).
2. These terms and conditions are addressed to business clients and govern the principles and procedures for concluding a Sales Agreement with business clients through the Studioexpress online store.

§ 2 Definitions

1. Seller: Studioexpress Patrycja Witoń, headquartered at Strzeszyńska 33, 60-479 Poznań, registered under NIP 9721337473 and REGON 524748299.
2. Client: A business entity purchasing via the Studioexpress online store.
3. Entrepreneur: An individual, legal entity, or organizational unit with legal capacity operating a business activity in its own name, using the Studioexpress online store.
4. Online Store: Studioexpress operated by the Seller at www.studioexpress.pl.
5. Distance Agreement: A sales agreement concluded with the Client through the Studioexpress online store using communication methods exclusively at a distance.
6. Terms and Conditions: This document governing the Studioexpress online store's operations.
7. Order: The Client's declaration of will made through the Order Form, aiming to conclude a Sales Agreement with the Seller for the purchase of one or more Products.
8. Account: The Client’s account on the Studioexpress online store where their data and order history are stored.
9. Registration Form: A form available on the website to create an Account.
10. Order Form: An interactive form available on the Studioexpress online store used to place an Order, particularly by adding Products to the Cart and determining delivery and payment options.
11. Cart: A section of the Studioexpress online store where selected Products are displayed, and the details of the Order can be adjusted, including quantities.
12. Product: A tangible item or service offered for sale in the Studioexpress online store.
13. Sales Agreement: An agreement for the sale of a Product concluded between the Client and the Seller through the Studioexpress online store.

§ 4 Technical Requirements

To use the Studioexpress online store, including browsing the assortment and placing orders, the following are required:
a. An internet-enabled device with a web browser,
b. An active email account,
c. Cookies enabled,
d. FlashPlayer installed (for video playback).

§ 5 General Information

1. To the extent permitted by law, the Seller is not liable for interruptions in the operation of the online store caused by force majeure, unauthorized third-party actions, or incompatibility of the Client's infrastructure with the online store's system.
2. Orders can only be placed after providing the necessary personal and address details for order fulfillment.
3. Prices in the store are stated in Polish zloty (PLN) and include VAT.
4. The final price includes the Product price and delivery cost, which are specified during the ordering process.

§ 6 Account Creation

1. To create an account, the Client must complete the Registration Form with valid company details registered in CEIDG or KRS.
2. Account creation is free of charge.
3. Logging into the account requires a login and password created during registration.
4. The Client may delete their account at any time by sending a request via email or post to the Seller's address.

§ 7 Order Placement

To place an order:

1. Log in to the store.
2. Select a Product and click “Add to Cart.”
3. Click “Order and Pay” and confirm the order through the email link.
4. Select a payment method and complete the payment within the specified timeframe.

§ 8 Delivery and Payment Methods

1. Delivery methods:
   a. Courier service.
2. Payment methods:
   a. Bank transfer in advance.
   b. Electronic payments via BlueMedia S.A. (details at https://bluemedia.pl).
   c. Payment cards: Visa, Visa Electron, Maestro, MasterCard, MasterCard Electronic.

§ 9 Sales Agreement Execution

1. A Sales Agreement is concluded once the Seller confirms the Order via email.
2. The email confirmation includes the order details and agreement terms.
3. Payment must be completed in advance. Unpaid orders will be canceled.
4. Products are shipped as specified in the order description.
5. Worldwide shipping is available.

§ 10 Product Complaints

1. The Seller's liability for defective products is governed by applicable laws, particularly the Civil Code.
2. Complaints can be submitted via:

3. Complaints should include: (1) details about the issue, (2) the requested resolution, and (3) contact information.

§ 11 Withdrawal from the Agreement

1. Customized, non-prefabricated products tailored to the Client’s specifications are exempt from the right of withdrawal.

§ 12 Final Provisions

1. Agreements are concluded in Polish.
2. The Seller may amend these Terms for legal or operational reasons with seven days’ notice.
3. Matters not covered by these Terms are subject to Polish law.
